Patent agents in the utility model application process

A utility model application should be drawn up as carefully as a patent application. It should be composed in the right way right from the beginning, because no additions are allowed after the application has been filed. The claims should also hold out against possible attempts to invalidate the utility model or cases of infringement. Also, when applying for a utility model abroad, there are many different patenting systems which the applicant should know sufficiently in order to avoid losing money. The help of an expert is therefore often needed in the process.

The Act on Utility Model Rights does not require that an applicant employs an expert in the application process. If the applicant appoints an agent, there are no restrictions as to his or her personality. Professional patent agents draw up utility model applications as part of their work.
