Lodging of Appeals

When the National Board of Patents and Registration has taken a decision that is subject to appeal, the party concerned is given instructions for lodging an appeal.

The petition of appeal is to be addressed to the Board of Appeal.

It shall be made in writing and submitted in three copies, with the annexes, to the NBPR Registry (NBPR Client Service) within the appeal period, i.e. within 60 days from the receipt of service.

The appeal shall state at least

• the complainant’s name, domicile and address;
• the decision appealed against;
• the item or items appealed against in the decision;
• the amendments required to be made to it;
• the grounds for the required amendments.

The appeal writ shall be signed by the complainant, the legal representative, or by the agent.

The established appeal fee, 200 euros, must be paid to the NBPR within the appeal period. If the complainant fails to make the payment, the appeal will not be admitted.

The appeal writ shall be accompanied by at least

• the decision appealed against, in original or as a copy;
• a certificate stating the date on which the decision was notified;
• a proof of payment of the appeal fee;
• the proxy of the agent.
