The Industrial Property Attorney Board operates under the auspices of the Finnish Patent and Registration Office, and provisions on the board are contained in the Act on Authorised Industrial Property Attorneys (22/2014).

The Industrial Property Attorney Board keeps two registers: the register of examinations of industrial property attorneys and the register of industrial property attorneys (register of attorneys). The Industrial Property Attorney Board collects to the registers information on persons who have taken part in the examination of attorneys organised by the Industrial Property Attorney Board or who have been granted authorisation by the Industrial Property Attorney Board. The purpose of the processing of personal data is to grant and extend authorisations, supervise the activities of the attorneys and to ensure that the parties requesting industrial property services can verify valid authorisations.

Compliance with Article 6(1)(c) of the EU’s General Data Protection Regulation (controller’s statutory obligation) serves as the legal basis for processing personal data.

Personal data storage periods

The storage periods of the personal data contained in the registers are based on the archive formation plan, under which the data is stored on a permanent basis.

Personal data processed by the PRH

The following personal data is processed by the PRH: name, personal identity code, municipality of residence, address and work address of the examination participants and authorised attorneys. Other contact details, such as email addresses and telephone numbers can also be processed in connection with the contacts and provision of advice in the manner described in the privacy statement of the PRH’s customer service. The following data is also processed under the law:

  • details of the attorney’s examination,
  • details of the granting of authorisation and the date of extension,
  • details of the cancellation of authorisation,
  • sanctions imposed on an authorised attorney, and
  • name, result and date of the attorney’s examination.

Regular data sources

The information in the register of examinations of industrial property attorneys is entered on the basis of the registrations in the attorney’s examination received by the Industrial Property Attorney Board and the information submitted in the registrations. The examination results of the examination participants are also entered in the register.

The information in the register of industrial property attorneys is entered on the basis of the applications for authorisation received by the Industrial Property Attorney Board and the information contained in the applications. The entries made in the register are based on the authorisations granted by the board. The notifications concerning the extension of the authorisation received by the board and the information contained in the notifications also serve as a source of information.

Disclosure of data

We may disclose your personal data in situations required and permitted by law.

The name, municipality of residence and work address of the authorised attorneys entered in the register of industrial property attorneys is public information. Information on the register can be obtained by ordering certificates and extracts from the register of attorneys and copies of the list of authorised attorneys and by making telephone enquiries. You can also access the documents concerning the register of attorneys in the PRH to the extent that they are public. The disciplinary sanctions imposed on the authorised attorneys are confidential information.

The Industrial Property Attorney Board may publish on the PRH’s website the names, municipalities of residence and work addresses of the authorised attorneys. However, an authorised attorney has the right to refuse to have their information published.

Information from the register of attorney’s examinations is only disclosed to the persons concerned.

Personal data is also processed by the data system administrators and developers with whom the PRH has agreed on the processing of personal data in accordance with the requirements of the data protection legislation.

Transfer of data outside the EEA countries or to international organisations

No data is transferred outside the EU or the EEA or to international organisations.

Automated decision-making

No personal data is used for automated decision-making.

Right of access to your own data

Right to rectification of data

You have the right to rectify inaccurate and incorrect personal data on you.

Give the following information in the rectification request:

  • the data you want to correct (word for word)
  • proposed changes (word for word)
  • justification for the proposed changes
  • your name
  • your contact information (such as email address or telephone number).

Right to restrict processing

The processing of the personal data is based on the statutory obligation of the PRH and the performance of a task carried out in the public interest. In such cases, you cannot request the deletion of your personal data or its transfer to another system and, as a rule, you cannot object to the processing of your personal data.

Right to submit a complaint to the supervisory authority

If you consider that your personal data is processed unlawfully, you can submit a complaint to the Office of the Data Protection Ombudsman.
