Administrative revocation and invalidation procedure

You can apply for the revocation and invalidation of a trademark at the Finnish Patent and Registration Office (PRH) through an administrative procedure. We will decide on the matter based on your application and written statements. The application is subject to a fee.

In an administrative procedure, claims can only be made against registered trademarks, not against established trademarks.

Court proceedings

You can also claim the revocation and invalidation of a trademark in the Market Court by bringing a legal action against the trademark owner.

Which authority: the PRH or the Market Court?

You can decide whether you submit an application to the PRH or bring a legal action before the Market Court. The administrative procedure at the PRH does not allow for the processing of any other civil matters, such as a claim for compensation.

We will not start processing the application if a matter pertaining to the same trademark is pending in the Market Court between the same parties. Similarly, we will stop processing the application if a matter pertaining to the same trademark becomes pending in the Market Court.
