Finnish Patent and Registration Office to monitor copyright organisations from 1 January 2017

On 8 December 2016, the Finnish Parliament’s plenary session approved the government proposal for an act on collective management of copyright. The purpose of the act is to improve the functions of the copyright market and to contribute to the transparency of the collective management of copyright. Under the new act, the Finnish Patent and Registration Office (PRH) will be in charge of monitoring organisations that manage copyright in Finland.

There are seven associations in Finland managing copyright and related rights on behalf of rightholders. They are:

  • Teosto (Finnish Composers' Copyright Society),
  • GRAMEX (Copyright Society of Performing Artists and Phonogram Producers in Finland),
  • Kopiosto (copyright organisation for authors, publishers and performing artists),
  • TUOTOS (copyright society for audio-visual producers),
  • Kuvasto (copyright society for artists working in the field of visual arts),
  • Sanasto (Finnish literary copyright society), and
  • Filmex (copyright organisation for actors).

They are all approved as extended collective licence organisations, except Filmex.

The PRH’s monitoring is mainly of an ex-post nature and is based on requests for measures or on information the PRH has received in some other manner. Copyright organisations must file a notification with the PRH before they start operating, while copyright organisations already engaged in collective management of copyright must file a notification with the PRH within one month from the entry into force of the act.

The yearly cost of the monitoring is about 120,000 euros, which will be financed from the state budget.

The PRH is in charge of auditor oversight and the supervision of foundations in Finland, which will support this new monitoring function.
